These Terms & Conditions (“Terms”) govern your use of the GenDex Studios website at gendexstudio.co.za (the “Site”) and your purchase of any digital assets, plug-ins, or services we make available through it. By accessing the Site or buying anything from us you confirm that you have read, understood, and agreed to these Terms.

1. Who we are

GenDex Studios is a South African sole-proprietor business operated by Nathan van Dyk, providing outsourced game-development services and digital products to studios and individuals. You can reach us at gendexstudio@gmail.com.

2. Accounts

To purchase or download products, you must create an account using a valid email address. You are responsible for keeping your login credentials confidential and for any activity on your account. Notify us immediately if you suspect unauthorised access.

Accounts must be held by individuals aged 18 or older, or used with the consent and supervision of a parent or legal guardian.

3. The products we sell

We sell digital goods — 3D assets, plug-ins, source files, scripts, shaders, sounds, and similar — intended for use in game development and related creative work. Product pages describe what is included. Specifications may change without notice as we improve or update files.

4. Licence to use what you buy

When you buy a product from us, you are granted a perpetual, non-exclusive, non-transferable, royalty-free licence to use the files in commercial and non-commercial projects, subject to the following:

• You may not resell, redistribute, sub-licence, or share the raw files with anyone outside your team.
• You may not include the unmodified files as a stand-alone product in another marketplace or asset pack.
• You may use the files inside games, films, animations, advertisements, and similar derivative works without further permission.
• You may modify the files for your own use. Modifications do not grant ownership of the underlying asset.
• All copyright and intellectual property in the original files remains with GenDex Studios.

5. Payments

Payments are processed by third-party payment providers (such as PayFast). We do not store your card details. Prices are listed in South African Rand (ZAR) unless otherwise indicated and include applicable taxes where required.

By completing checkout you authorise the listed amount to be charged to your chosen payment method. If a payment fails, declines, or is reversed (e.g. chargeback), we may suspend access to the associated downloads pending resolution.

6. Delivery

Once payment is confirmed, the purchased file becomes available for download from the My Downloads page on your account. Download links are short-lived but can be regenerated by re-visiting My Downloads at any time. You are responsible for downloading and storing the files you purchase; we recommend keeping a personal backup.

7. Refunds & cancellations

Because the products are digital and delivered instantly, all sales are generally final. Our full policy — including the limited circumstances in which a refund may be granted — is set out on our Refund & Cancellation Policy page.

8. Prohibited use

You agree not to:

• Use the Site or our files in any unlawful, infringing, or harmful manner.
• Attempt to access another user’s account or our admin or storage systems without authorisation.
• Circumvent any access, download, or licensing controls.
• Scrape, mirror, or republish the Site or its catalogue.

9. Intellectual property

All content on the Site — text, design, code, files, branding, and artwork — is owned by GenDex Studios or its licensors and is protected by South African and international copyright laws. Buying a product grants the licence described above, not ownership.

10. Disclaimers

The Site and the products are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, GenDex Studios disclaims all warranties, express or implied, including fitness for a particular purpose. We do not guarantee that the Site will be uninterrupted, error-free, or compatible with every engine, runtime, or version of third-party software.

11. Limitation of liability

To the fullest extent permitted by law, GenDex Studios’ total liability arising out of or related to these Terms or any product is limited to the amount you paid for the product giving rise to the claim, in the 12 months preceding the event. We are not liable for indirect, consequential, or punitive damages.

12. Privacy

We process personal information in accordance with the Protection of Personal Information Act (POPIA). We collect only what is needed to run the Site, process orders, and contact you about your account. We do not sell your data. If you want a copy of your data or want it deleted, email gendexstudio@gmail.com.

13. Changes to these Terms

We may update these Terms from time to time. When we do, the “Last updated” date at the top of this page will change. Material changes will be highlighted on the Site or sent to you by email where reasonable.

14. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any dispute that cannot be resolved by good-faith discussion will be submitted to the exclusive jurisdiction of the South African courts.
